Please read the following conditions (the "general conditions") carefully before ordering a product from this website. Any order placed via this website will be subject to these general terms and conditions.

Emile-Simon reserves the right to modify these general terms and conditions if necessary and without notice. It is advisable to consult the most recent version of the general terms and conditions before placing an order. By ordering products after we have made amendments to these general terms and conditions, you confirm that you accept the new terms and conditions.

1.ORDER PROCEDURE

All products shown on the Website are subject to availability. Whilst we endeavour to include accurate and up-to-date information on the Website, some products shown on the Website may no longer be available for sale. No rights can be derived from typographical errors, product descriptions or obvious mistakes on the website.

We make every effort to present our products using high quality images. Colours and other variations in the images of our products may occur due to the settings of the monitor or device you use to surf our website.

The product offer on our website is not binding. All orders are subject to our acceptance. Emile-Simon reserves the right to modify the product offer on the website at any time.

Once you have chosen a product to order, click on the "+ Add to basket" button or on the button with a "+" sign followed by the image of a shopping basket. The selected product will be added to your shopping cart. At any time you can check the products you have selected by clicking on the shopping trolley in the top right-hand corner and remove or add any product.

When you have selected all your products and wish to confirm the contents of your shopping cart, click on "Checkout" and follow the further instructions. You will be asked to log in to your account. If you do not yet have an account for our website, you can register by clicking on the appropriate link. To do so, please enter your name, address, e-mail address, telephone number and delivery address. The data of your account are personal and will never be shared with third parties. Once your account has been created, you can log in to the website with your personal login and password and the registration process does not have to be repeated.

Please check the accuracy of the selected products before confirming the order. If you agree with the selected products and the price, click on the "Place Order" button. You will then be asked to enter your payment details. By clicking on the "Place Order" button, you are placing a binding order for the products in your shopping cart.

All orders must be paid at the time of order. We accept the following payment methods: Cash, Credit Card, KBC/CBC Payment Button, Belfius Direct Net, Bank Transfer, iDeal.

The products remain the property of Emile-Simon until full payment of the purchase price by the customer. Irrespective of the title of ownership, the risk of loss and damage passes to the customer at the time of delivery.

The order is successfully placed as soon as it is confirmed by Emile-Simon by means of a confirmation e-mail sent to the e-mail address [email protected]. With this confirmation e-mail, Emile-Simon has not yet accepted the order from the customer. Indeed, all orders are subject to availability and acceptance and we reserve the right to refuse an order. Such refusal may be due, for example, to the fact that a product is no longer available; we cannot obtain authorization for your payment; shipping restrictions apply. In this case, we will immediately inform you of the fact that the products cannot be delivered and we will immediately refund the amounts already paid for the unavailable products.

The sales contract will be deemed to have been concluded when you receive confirmation from Emile-Simon that the products have been shipped to you. You can also consult the status of your products at any time in your personal account under the heading "Orders".

The products are sold at the price in force at the time of the order, as indicated on our website. The prices are indicated in euros, inclusive of VAT and inclusive of the delivery costs borne by Emile-Simon. Orders are payable in euros, whatever the delivery address or the place of residence of the customer. Emile-Simon assumes responsibility for any customs duties or other similar local taxes.

Emile-Simon reserves the right to modify its prices at any time, but these modifications will not apply to orders for which you have already received a confirmation email, except in the case of an obvious mistake in the price indication. In that case, we will inform you as soon as possible about the problem with the indicated price. You have the right to cancel your order after we have informed you of the error.

2.INTELLECTUAL PROPERTY

Emile-Simon is the owner and/or authorized user of all trademarks, service marks, design marks, patents, copyrights, database rights and other intellectual property rights concerning the website and the products. Your use of the Website does not confer on you any right, title, interest or licence in such intellectual property rights. In particular, it is prohibited to copy or reproduce the website and/or any part thereof, including the pictures of the products.

3.LIMITATION OF LIABILITY

These Terms and Conditions are not intended to exclude or limit the liability of either party for any loss or damage where it would be unlawful to do so. This includes any liability for death or personal injury caused by the failure of the liable party to exercise reasonable care and competence; or for gross negligence or wilful misconduct.

4.LEGAL INFORMATION

Belgian law shall apply, with the exclusion of the provisions of private international law, as well as the UN Convention on Contracts for the International Sale of Goods of 1980. In case of dispute, only the courts of the district of Emile-Simon's location are competent.
